For the most part, this page tells users the terms on which we license them to use our mobile application software and all data we supply with the software and any updates or supplements to it (the “app”) and our website at morepaws.co.uk (the “website”) (together, “MorePaws”). As MorePaws is a place where “business owners” can advertise their goods or services, these terms also apply to those business owners
By downloading, signing up to or using MorePaws, whether as a user or as a business owner, you accept these terms and agree to comply with them. If you don't accept them, you must not use MorePaws
MorePaws is owned and operated by MorePaws Limited, a company registered in England and Wales under company number 14303146 with its registered office at 12 Lynway Drive, Manchester, United Kingdom, M20 4TS (“we” or “us”).
What is MorePaws?
MorePaws is a social networking community aimed at dog owners. It is a place where you can engage and interact with other dog owners, so that you can share photos or videos, chat, or share locations of great places to walk your dogs. You can then choose to meet up with other dog owners to go on walks together.
You'll see that we also advertise the goods and services of brands. These will change from time to time and may include dog-friendly businesses, dog products, or anything else. We have relationships with these brands and if you make a purchase of any of their goods or services, you'll be entitled to a discount. This is explained later in these terms.
Downloading the app
You need to have an iOS or Android device to download the app. Please note that your use of the app may be subject to the rules of the app store from which you downloaded the app, i.e., the Apple App Store and Google Play. You should read the terms and conditions and privacy and cookies policy of the app store as these will apply to your downloading of the app.
Using MorePaws
You must be at least 18 years old to use and create an account on MorePaws and have legal capacity to enter into a legally binding contract with us. You have permission for temporary use of MorePaws, but we can withdraw or change our service at any time without telling you and without being legally responsible to you.
You must treat all identification codes, passwords, and other security information as confidential. If we think you have failed to keep confidentiality, we are allowed to disable any security information (including your passwords and codes). You must not allow anyone else to use MorePaws using your login details. MorePaws is licensed only to you and you may not rent, lease, sub-license, sell, assign, pledge, transfer, or otherwise dispose of MorePaws, on a temporary or permanent basis. If you sell any device on which MorePaws is installed, you must remove MorePaws from it.
Only use MorePaws as allowed by law and these terms. If you don't, we may suspend your usage, or stop it completely.
Your use of MorePaws will require an active internet connection, whether wi-fi or 3G/4G/5G. We cannot take responsibility for the way you use MorePaws, and so you must ensure you have an active internet connection and a charged device to benefit from MorePaws.
Subscription to MorePaws
MorePaws will be operating as a subscription model but will be free for the time being. As it stands, the platform is free for users to join and to have full access to the platform. For future reference, at some point MorePaws will introduce a subscription fee which will be explained accordingly when the time is due. By agreeing to the terms, you accept that you will be introduced to the possibility of a payment method further down the line.
Further information about your Premium Subscription
If you choose to cancel your Premium Subscription, or downgrade to a Basic Subscription, you can update this in MorePaws. Your Premium Subscription will automatically end (or revert to a Basic Subscription) at the end of the month or year, depending on whether you pay monthly or annually, and you will continue to have access to the benefits of your Premium Subscription until cancellation or downgrade. You cannot claim a refund if you pay for a Premium Subscription but don't use MorePaws.
Under consumer legislation, MorePaws (and your Subscription) must be as described, fit for purpose and of satisfactory quality. If MorePaws is faulty, you're entitled to a repair or a replacement and if we can't repair the fault within a reasonable time, we will refund you your Subscription fees. If you can show the fault with MorePaws has damaged the device you used to access MorePaws and that we haven't used reasonable care and skill, you might be entitled to a repair or compensation.
Updates to MorePaws
From time to time we may automatically update the app and change MorePaws to improve performance, enhance functionality, reflect changes to the operating system or address security issues. Alternatively, we may ask you to update the app for these reasons. If you choose not to install such updates you may not be able to continue using the app.
Discounts
Where you have a Premium Subscription, you are entitled to a discount on the goods or services of brands that we advertise on MorePaws. Our marketing or promotion of the brands on MorePaws is not an endorsement by us of the brand, its associates, or its goods or services.
While we facilitate the discounts offered, we are not responsible for administering the discount to you, nor for ensuring that the brand honours the discount, nor for the goods or services purchased using the discount. We therefore recommend that you do your own research and ensure that those goods or services are suitable for you and your circumstances.
Claiming the discount will be subject to the brand's terms and conditions, which may include limitations and exclusions. Please carefully review the brand's terms and conditions and privacy notices before claiming the discount.
Please note that we cannot represent you in any claim against the brand for its failure to honour the discount or for any other reason, and your only recourse in such an event would be to contact the brand directly. Finally, please use caution and discretion when interacting with brands and making purchases, as we are not responsible for any issues that may arise from such interactions.
Registering as a business owner on MorePaws
We're very selective about the businesses we advertise on MorePaws, as we want to be certain that they align with our core beliefs and principles.
Before we accept you, we first undertake full diligence on your business, such as by checking your online reviews and social media posts. Whether we choose to accept you is at our sole discretion and without liability to you.

Purchasing the goods/services of a business advertising on MorePaws
MorePaws gives business owners the chance to advertise their goods and services to you.
Although we do undertake due diligence on those businesses, such as by checking their reviews and social media posts, we are not in any way endorsing those businesses, or their goods or services.
If you choose to purchase any goods or services from these businesses, this is at your sole decision and risk and we are not liable to you in any respect for any loss or damage arising from your contract with that business.
We therefore recommend that you do your own research and ensure that those goods or services are suitable for you and your circumstances.
Privacy and data protection
One of the features of MorePaws is the ability to share your location with the community, whether you're on the move or you tag a place you've been. This means that we will collect, process and share that location data, along with other kinds of personal data. We are committed to protecting the personal data that you choose to share with us when using MorePaws. You must read our privacy policy to understand how we handle your personal data. By downloading the app and using MorePaws, you are consenting to the sharing of your location data with others and with us.
You should be aware that transmission of information over the internet is never completely private or secure and that any information you send using MorePaws or any service may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.
Intellectual property rights
In a nutshell, intellectual property rights means the rights granted to those that create anything, whether it is in trade marks, text, content, typographical arrangements, designs, photos, graphics, layouts or anything else. MorePaws is full of intellectual property rights that we either own or we have licensed from others.
All content you find on MorePaws, save for user-generated content, are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any pages from MorePaws for your personal use. That being said, you are not permitted to modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. You must not use any part of the content on MorePaws for commercial purposes without obtaining a licence to do so from us or our licensors. Our status as the creators of MorePaws and anything you find on it must always be acknowledged (except where the content is user-generated).
If you print off, copy, download, share or repost any part of MorePaws in breach of these terms, your right to use MorePaws will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

MorePaws is a community where dog owners can interact with each other and share their passions for their four-legged friends. We therefore want to ensure that MorePaws is a safe place for this to be done and so we have very strict guidelines that you must follow while using MorePaws.
When you engage with other users, or you post on MorePaws, whether as a user or a business owner, it is essential that you follow our content standards. By using MorePaws, you agree that you will not use MorePaws:
Although we do moderate the interactions on MorePaws, and we do our best to remove any content that breaches the standards set out in these terms, we can't be held responsible for the opinions, comments, statement or activities of users of MorePaws. If you come across any content you consider is contrary to our expected standards, we kindly ask that you notify us so we can take action to remove the content.
If you breach our standards, we reserve the right to delete your account and to delete all contributions you have made to MorePaws without any liability or responsibility to you or any third party.
Updates to your business owners MorePaws profile and/or account
To ensure a more positive experience for everyone that uses MorePaws, where any aspect of your profile, such as the profile picture, doesn't align with our standards or acceptable use, we reserve the right to make necessary changes to bring it in line with our guidelines. We believe this will help maintain a professional and consistent platform for everyone.
If you encounter any challenges while completing your profile, our team may assist you in making the necessary updates. Your success is our priority, and we're committed to helping you present your offerings in the best possible light.
Computer misuse
You must not conduct, facilitate, authorise, or permit any text or data mining or web scraping in relation to MorePaws. This includes using (or permitting, authorising, or attempting the use of):

The provisions in this section should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).
This section shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.
User generated content
You warrant that any content you upload to MorePaws, whether as a user or a business owner, complies with our expected standards, and you'll be liable to us and indemnify us for any breach of that warranty, meaning you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
Any content you upload to MorePaws (including without limitation text, photos and videos) will be considered non-confidential and non-proprietary. You will retain all of your ownership rights in your content, but you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, store and copy that content and to distribute and make it available to third parties or on other media, for our own commercial purposes.
We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to MorePaws constitutes a violation of their intellectual property rights, or of their right to privacy.
Your safety
As we've mentioned before, it is up to you if you would like to meet up with another user of MorePaws in person, and whether you do this is completely at your discretion. However, before you do, there's a few things you need to consider:

By choosing to meet up with someone you have interacted with on MorePaws, you acknowledge and fully accept that this is your decision and that you are solely responsible for your own safety and well-being during any meet up with that person.
We shall not be liable or responsible to you or anyone else for any loss, damages or harm that may arise from any interactions between you and any person you meet on MorePaws, whether in-person, on MorePaws or outside MorePaws.
Legal responsibility
MorePaws is provided to you ‘as is' and without any warranty of any kind. We disclaim all warranties regarding MorePaws to the fullest extent permitted by applicable law, whether express or implied, including any and all implied warranties of merchantability, accuracy, results of use, reliability, fitness for a particular purpose, title, interference with quiet enjoyment, and non-infringement of third-party rights. In particular, we disclaim any warranty that your use of MorePaws will be uninterrupted or error free. We are not liable for any downtime or where MorePaws is unavailable to you.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. Nothing in these terms shall limit our liability for death or personal injury arising from our negligence, or for fraud, or for anything else which cannot be limited or excluded by applicable law.
MorePaws is for private use and for not any commercial or business use, unless we otherwise provide our prior written agreement and in which case, we will not have any liability to you for any loss of profits, loss of business or loss of business opportunity, or for any business interruption.
We shall not be liable in contract, tort (including negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise to you or any third party for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with your use of MorePaws. In particular, we exclude legal responsibility for any indirect, special or consequential loss or damage.
Our legal responsibility to you under these terms shall be limited to directly foreseeable loss if you are a consumer, and £1,000 if you are a business owner or business.
Indemnification
You agree to defend, indemnify, and hold us harmless from and against any and all liabilities and expense whatsoever - including without limitation, claims, damages, judgments, awards, settlements, investigations, costs, legal fees, and disbursements - which any of them may incur or become obligated to pay arising out of or resulting from the offering for sale, the sale, and/or use of MorePaws, excluding, however, any such expenses and liabilities which may result from a breach of these terms or sole negligence or wilful misconduct by us. In consideration of and as part of your use of MorePaws, you hereby release, waive, acquit, discharge, indemnify, defend, hold harmless and forever discharge us of and from all actions, causes of action, contracts, claims, suits, costs, demands and damages of whatever nature or kind in law or in an equity arising from your use of MorePaws.
Termination
We reserve the right to terminate these terms immediately on written notice to you in the event that you commit a breach of these terms. If the event that these terms are terminated for any reason, all rights and licences granted to you by these terms will stop immediately and you must stop use of MorePaws immediately
Force majeure
Where an event outside our control occurs, this is a “force majeure event” and includes, but isn't limited to, storm, fire, earthquake, an act of God, a natural disaster, a failure of electricity or power supplies, epidemic, pandemic, government rules, regulations or guidance, or a failure of a third-party supplier to do as they're contracted to do. Where a force majeure event occurs, we are excused from performance under these terms, and we won't be liable to you for our failure to perform. We will use our reasonable efforts to continue our obligations under these terms as soon as we are able to after the force majeure event has stopped.
General
Links from MorePaws. Any links from MorePaws to other websites are for information only. We don't control them and don't accept responsibility for other websites, or any materials found upon them or any loss you suffer from using them.
Changes to these terms. We reserve the right to change and amend these terms from time to time. You should check back regularly to ensure you are reading the most up to date version of these terms, as the same will apply to your use of MorePaws at all times.
No waiver. No failure or delay by us in exercising any of our rights under these terms shall be deemed to be a waiver of that right, and no waiver by us of a breach of any provision of these terms shall be deemed to be a waiver of any subsequent breach of the same or any other provision.
Severance. In the event that one or more of the provisions of these terms is or are found to be unlawful, invalid, or otherwise unenforceable, that or those provision(s) shall be deemed severed from the remainder of these terms. The remainder of these terms shall be valid and enforceable.
Entire agreement. These terms and any other document specifically referred to herein contains the entire agreement between us and you with respect to its subject matter and formation. These terms supersede and extinguish any and all previous agreements, representations, warranties, promises, assurances, and understandings between us and you relating to its subject matter and formation.
Third party rights. Unless it expressly states otherwise, these terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms.
Applicable Law. These terms and any non-contractual obligations arising hereunder, shall be governed by, and interpreted according to the law of England and Wales and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the English and Welsh courts.
